Terms of Use
These terms govern the use of the platform. No goods or services are sold through this website and no contracts for consideration are concluded; the platform is a service provided by Open item 1:[Responsible body] to the eligible user groups.
1. Scope
These terms apply to everyone who has been granted access to this platform — both to representations publishing offers and to commercial agents viewing them.
2. Access
There is no self-registration. Accounts are vetted and created internally. There is no entitlement to be granted an account.
Credentials are personal. They must not be passed on or shared. Anyone who suspects that unauthorised persons have gained knowledge of them must report this without delay to Open item 2:[reporting point for security incidents].
3. Permitted use
The offers may be used solely for the purpose for which the platform exists: initiating a commercial representation between the company seeking one and a commercial agent.
In particular, the following are prohibited:
- automated extraction of the content, by whatever tool;
- systematic reproduction, building a separate database from the content, and passing it on to third parties;
- using the information for advertising, address trading or bulk mailings;
- any attempt to circumvent access restrictions or to view other users’ data.
4. Obligations of representations
The representation publishes offers on its own responsibility and ensures that the information is accurate and current.
Where an offer contains details of named individuals — for instance a contact person with a name, address or contact details — these are personal data of third parties. The representation warrants that it is entitled to publish this information and has informed the person concerned.
The representation further warrants that it holds the necessary rights to any texts and images it publishes.
5. Obligations of commercial agents
An enquiry made through the platform serves to initiate a representation. It must not be used for self-promotion, for offers to the representation, or for unrelated purposes.
Information an agent learns from an offer is to be treated as confidential, unless it is public in any case.
6. Availability
The platform is operated with due care. There is no entitlement to uninterrupted availability; maintenance, faults and measures against attacks may cause interruptions.
7. Expiry and deletion of offers
Offers expire when nobody attends to them: publishing, saving and renewing set validity to the end of the following month, after which the offer is archived automatically. The representation is reminded by e-mail before expiry.
Deleted content can be restored only after contacting Open item 1:[Responsible body] and only within thirty days. On whether backup copies exist beyond that, see the privacy policy.
8. Suspension and termination
In the event of a serious or repeated breach of these terms, Open item 1:[Responsible body] may suspend or terminate access. Open item 3:[Define the procedure: warning before suspension? Who decides? Is there a right of appeal?]
An account may be terminated at any time without formality. The consequences for stored data are set out in the privacy policy.
9. Liability
No liability is accepted for the accuracy, completeness or timeliness of the offers published by representations, nor for the conclusion or success of any cooperation initiated through the platform.
